Walsall Hospitals Branch believes that many NHS employers are applying inconsistencies when using bank workers as a deliberate ploy to prevent the payment of overtime and unsociable hours payments enjoyed by NHS employees.
NHS employers are engaging staff on separate bank workers contracts in order to avoid paying the appropriate AfC overtime rates.
The Walsall Hospitals Branch believes that staff employed on zero hour contracts should receive the same terms and conditions set out under Agenda for Change accruing both annual leave and unsocial hours payment entitlements.
Walsall Hospital Trust Branch calls upon the Service Group Executive to engage with the national employers side to ensure that NHS employers adhere to the Agenda for Change terms and conditions in the spirit in which they were intended and take the appropriate action where rogue NHS employers do not adhere to the terms set out under Agenda for Change. Further, the Walsall Hospitals Trust Branch calls upon the Service Group Executive to publicise all such NHS employers who fail to uphold the agreement.
