Conference welcomes the introduction of the National Care Standards Commission and the duty it has to raise standards across residential and nursing home care for people with learning disabilities and mental health illness.

However, we have serious concerns about the way in which the Commission appears to have failed to consult with UNISON on a number of documents setting out regulations/standards which may directly affect members of staff. For example the “Care Homes for Younger and Adult Placements (national minimum standards care home regulations) make it clear that all allegations made against any member of staff working in a home have to be reported, and that such allegations would remain on their record whether these allegations are proven or not.

Conference considers this to be unfair practice and “against the rules of natural justice”. Conference therefore calls upon the Service Group Executive and National Officers to urgently look at the implications that these regulations might have upon our members, and where necessary to open discussions with the Department of Health and the National Care Standards Commission to seek changes which would better reflect fairness and support for our members and the clients for whom they care.
