   <title>Bullying and harassment landmark judgement</title>
	<description>(28/11/06) A recent House of Lords decision in the case of Majrowski v Guy’s and St Thomas’s NHS Trust [2006], established that the Protection from Harassment Act 1997 can apply to workplace bullying and harassment.  Prior to this decision, it was not clear that the Act, which was introduced to deal with stalkers, covered harassment and bullying at work.  This case involved a claim to the county court that the former employer was vicariously liable for the homophobic bullying the worker had experienced from his line manager. The Law Lords ruled that an employer could be held vicariously liable and ordered to pay damages for harassment of one worker by another, as long as the bullying was closely connected with the duties of the job.  We can use this case in negotiations, to point out that bullying and harassment policies need to be robust enough to stand up to the implications of this landmark decision.
