Welcome to the first edition of the UNISON migrant workers newsletter. The newsletter is produced by the migrant workers unit and is part of the Migrant Workers Participation Project.
Our aim is to keep migrant workers in UNISON informed about the latest developments and to encourage them to become active in their union. You can read more about what we are doing on the migrant workers website: www.unison.org.uk/migrantworkers

UNISON celebrates International Migrants' Day
International Migrants' Day is celebrated across the world on 18 December. On this day, in 1990, the General Assembly of United Nations adopted the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families.
This year, UNISON will celebrate the day with a reception and the launch of a photography exhibition: Migrants Care - give them dignity and respect. Invited guests include MPs, NGO leaders and colleagues and members from UNISON and other trade unions and all of these who are working to make our country a better place for overseas workers. The most welcome guests are of course migrants themselves. The event will include a light buffet and live Latino music provided by Los Musicos.

A 'pathway' to the future?
Migrant workers make a crucial contribution to the provision of public services in the UK. But migrants often find themselves undervalued and exploited. Trade unions can play a vital role in ensuring that migrants are treated with dignity and respect, and that they get a fair deal at work.
To be fully, effective trade unions need to reflect the views of their members. They can only do that if those members play an active part in the union. Unfortunately, many migrant workers lack the confidence to become active in the union or fear that they will put their job at risk by doing so.
The first weekend in December will see the first of a series 'Pathway' seminars aimed at encouraging migrant worker members of UNISON to become active. The seminar, which will be held at Birmingham University aims to demystify UNISON for its migrant worker members. We also want migrants to understand that they already have many of the skills that UNISON is looking for in activists.
The seminar is specifically designed to be accessible to everyone with a focus on doing and talking rather than lots of reading and writing. Some migrants who are active in the union already will be there to act as mentors and role models.
The course is already oversubscribed. But if you feel you would benefit from attending this course or think you know someone who would, please bear in mind this is the first of many and we would love to hear from you.
UNISON contribution to Polish Independence Day
On 8 November, Polish members of UNISON together with their colleagues from the migrant workers unit participated in the march from Westminster Cathedral to Trafalgar Square. The march was organised to celebrate the 90th anniversary of Polish independence. UNISON was one of the sponsors of this event. During the march, Polish leaflets including information about UNISON were distributed. People on the march were able to ask Polish UNISON members questions about contacting and joining UNISON. Many participants were pleased by the attention UNISON pays to Polish workers within the UK, and particularly reading in their own language that UNISON and one of the trade unions from Poland (OPZZ) work together to support workers' rights.
Since August this year, the migrant workers unit includes a seconded worker from OPZZ (Adam Rogalewski).

Despite the typical British weather the atmosphere was warm and sunny. UNISON's representation was surrounded by young and older people singing Polish songs and waving Polish national flags. Children particularly were very keen on UNISON's ponchos, provided by the union's members. The colourful march arrived in Trafalgar Square and at the end of the rally Londoners of both Polish and non-Polish nationality sang British and Polish anthems.
UNISON is very proud of its links with the Polish community in the UK, not only supporting Polish members on the basis of employment issues but also actively participating in their celebrations. UNISON recognises the positive contribution of the Polish community to British economy and also to history. We all know that a lot of Polish soldiers during the Second World War were pilots in the RAF and since that time many of them have lived in the UK.

Victory for senior carers - exemption on unfair requirements of new points-based system
"Without UNISON's support, many senior carers would have lost their jobs and the right to stay in the UK. We are very grateful that you have shown us how we can fight for our rights." Evelyn Bolano, senior care worker
UNISON has been the driving force behind the campaign to ensure that hundreds of senior carers who came to the UK under the old work permit system do not unjustly lose their jobs when Tier 2 of the government's new points-based system (PBS) is introduced. The points-based system has introduced new skills qualifications for senior carers. Many non-EU nationals who have already been taken into senior carer posts and who have often been working in their jobs for some years now found themselves "unqualified" for those jobs. When they lost their jobs they would also lose their right to remain in the UK.
Representations to government from UNISON resulted in the Home Office agreeing a new transitional arrangement, which will protect the senior carers from this injustice.
The transitional arrangement agreed by the Home Office specifically for senior carers provides for the continuation of the set of concessions which were gained in January 2008, when UNISON and migrant community organisations campaigned against the stringent implementation of the skills criteria for senior carers who had entered the UK under the work permit system.
The transitional arrangement drops the skills requirement, and if their existing employer refuses to pay the new #7.02 pence minimum rate, it allows these workers to try to find other employers who are prepared to do so. The transitional arrangement also allows senior carers who have been working for five years or more to retain the right to apply for indefinite leave to remain. Migrant Workers and their rights
On 18 November, UNISON officers participated in one-day training Migrant Workers and Their Rights organised in London by the migrants workers unit and Joint Council for the Welfare of Immigrants (JCWI). Participants were provided with up-to-date information regarding Immigration Law, particularly the new points-based system (coming into force in stages from January 2008 and through 2009) and employment law related to migrant workers. The tutors from JCWI were two barristers who specialise in these two sections of law, which are very often linked in cases of immigrants' rights. For instance, migrant workers subjected to discrimination on the grounds of race or gender are sometimes afraid to submit a grievance against their employers because they could lose their jobs and consequently their right to stay in the UK. The course's format was a mixture of presentation on new governmental policy and legal issues followed by case studies and discussion. Participants were able to share their experience of working with members of UNISON who came to work here from abroad.

Drogi do przyszłości?
Pracownicy migracyjni mają istotny wpływ na prawidłowe działanie przedsiębiorstw sfery publicznej w Wielkiej Brytanii. Mimo tego emigranci często są niedowartościowani i wykorzystywani w swoim miejscu pracy. Związki zawodowe mogą odegrać istotną rolę w upewnieniu się, że emigranci są traktowani z godnością i respektem oraz że mają sprawiedliwe umowy w miejscu pracy.
Związki zawodowe po to żeby mogły działać bardziej efektywne muszą koncentrować się na swoich członkach. Mogą to robić jednak tylko wtedy kiedy ich członkowie odgywają w nich aktywną rolę. Niestety wielu pracownikow migrujących nie ma na tyle pewności siebie, żeby zostać aktywnymi członkami, albo obowiają się, że ich aktywność może spowodować problemy w pracy.
W pierwszy weekend grudnia będziemy mogli zobaczyć pierwsze z serii wprowadzających szkoleń, ktorych celem jest wspieranie emigrantow na ich drodze do zostania aktywnymi członkami naszego związku. Szkolenie, ktore odbędzie się na Uniwersytacie Birmingham ma za zadanie wyjaśnić emigrantom jak działa UNISON. Chcielibyśmy rownież, żeby emigranci zrozumieli, że posiadają już oni właściwie umiejętności, ktorych UNISON wymaga od swoich aktywnych członkow.
Szkolenie jest przygotowane w taki sposob, żeby było łatwo dostępne dla każdego i koncentruje się bardziej na działaniu i rozmowie niż na czytaniu dużej ilości materiałow i pisaniu. Niektorzy pracownicy migracyjni są już aktywni w związku i będą uczestniczyć w tym szkoleniu jako mentorzy i pomocnicy.
Lista uczestnikow szkolenia jest już zamknięta, ale jeśli chciałbyś/łabyś wziąść udział lub znasz osoby, ktore są nim zainteresowane nie przejmuj się. Kursow tego typu będzie więcej i serdecznie Cię na nie zapraszamy.
Wkład UNISON do Polskiego Święta Niepodległości.
W dniu 8 listopada tego roku polscy członkowie UNISON wspolnie z ich kolegami z Departamentu ds. Pracownikow Migrujących uczestniczyli w pochodzie z katedry westminsterskiej na Trafalgar Square zorganizowanym dla uczczenia 90 rocznicy odzyskania przez Polskę niepodległości. UNISON był jednym ze sponsorow tego wydarzenia. Podczas pochodu wśrod jego uczestnikow rozdawane były ulotki w języku polskim dotyczące podstawowych informacji o UNISON. Polskim członkom zadawane były rożne pytania dotyczacę UNISON np. jak można skontaktować się ze związkiem zawodowym lub jakie są kryteria zostania jego członkiem. Wielu uczestnikow było zadowolonych z powodu tego jak wiele zainteresowania UNISON poświęca Polakom pracującym w Wielkiej Brytanii, w szczegolności poprzez to, że mogli przeczytać w ich własnym języku, że UNISON i związek zawodowy z Polski (OPZZ) wspołpracują ze sobą w celu ochrony ich praw. Od sierpnia tego roku do pracy w Departamencie ds. Pracownikow Migrujących delegowany został z OPZZ Adam Rogalewski.

Pomimo typowej angielskiej pogody atmosfera pochodu była ciepła i słoneczna. Przedstawiciele UNISON szli wśrod młodych i starszych ludzi śpiewających polskie piosenki i machających narodowymi flagami. W szczegolności dzieci były bardzo szczęśliwe z powodu płaszczy przeciwdeszczowych, ktore mogli otrzymać od członkow związku. Po tym jak kolorowy pochod dotarł na Trafalgar Square na zakończenie uroczystości Londyńczycy polskiego jak i niepolskiego pochodzenia zaśpiewali hymny Polskie i Wielkiej Brytanii.
UNISON jest dumny z powodu wspołpracy z polską społecznością w Wielkiej Brytanii nie tylko w związku z wspomaganiem jej w sprawach dotyczących zatrudnienia, lecz także aktywnie uczestnicząc w wydarzeniach przez nią organizowanych. UNISON jest świadomy pozytywnego wkładu polskiej wspolnoty do Brytyjskiej gospodarki a także histori. Wiemy bowiem,że wielu polskich żołnierzy podczas drugiej wojny światowej był pilotami RAF-u i od tego czasu niektorzy z nich żyją w naszym kraju.

UNISON prowadził aktywną kampanię na rzecz upewnienia się, że setki pracownikow domow opieki społecznej, ktorzy przybyli do Wielkiej Brytanii podczas obowiązywania starego prawa emigracyjnego nie stracą swojej pracy po wejściu w życie tiret 2 nowego prawa emigracyjnego. Prawo to bazuje na systemie punktow, ktore wprowadzają nowe wymagania dla pracownikow domow opieki społecznej. Wielu obywateli krajow, ktore nie są członkami Unii Europejskiej, a ktorzy przez kilka lat pracowali na stanowisku pracownika domu opieki społecznej byliby zgodnie z tym prawem traktowani jako osoby bez odpowiednich kwalifikacji do wykonywania swojej pracy. Jeśli zaś stracą pracę stracą rownież prawo do pobytu w Wielkiej Brytanii.
Rządowe przedstawicielstwo UNISON wymogło na Home Office zgodę na przedłużenie wyłączenia od stosowania nowych przepisow emigracyjnych wobec osob pracujących w domach opieki społecznej, ktorzy przyjeżdżają do Wielkiej Brytanii po wejściu w życie tych przepisow, co uchroni je przed niesprawiedliwością.
Wyłączenie powyższe zostało ustalone w styczniu 2008 roku, gdy UNISON wspolnie z organizacjami emigrantow walczył przeciwko zaostrzeniu wymagań dotyczących kwalifikacji.
Przedłużenie powyższego wyłączenia dotyczy wymaganych kwalifkacji zarobkowych i wobec tego jeśli pracodawca odmowia płacenia 7.02 funtow minimalnego wynagrodzenia (a tylko wtedy pracownik taki może legalnie pracować) uprawnia to pracownika do znalezienia pracodawcy, ktory będzie w stanie to zrobić. Daje rownież możliwość do starania sie o nieograniczone prawo pobytu pracownikom domow opieki społecznei, ktorzy pracowali w Wielkiej Brytanii pięć lub więcej lat.

Pracownicy migrujący i ich prawa
18 listopada pracownicy UNISON uczestniczyli w jednodniowym szkoleniu pt. ,Pracownicy Migrujący i ich prawa", ktore było zorganizowane przez Departament ds. Pracownikow Migrujących wspolnie z Joint Council for the Welfare of Immigrants (JCWI). Uczestnicy mogli się zapoznać z najbardziej aktualnymi informacjami dotyczącymi prawa emigracyjnego, w szczegolności nowego systemu bazującego na punktach, ktory częściowo wszedł w życie w styczniu 2008 roku a potem będzie stopniowo wchodził w życie w tym i następnym roku, a także prawem pracy w odniesieniu do emigrantow. Nauczycielami było dwoch adwokatow z JCWI specializujących się w tych dwoch działach prawa, ktore ze sobą bardzo często połączone jeśli chodzi o sytację prawną emigrantow. Często zdarza się bowiem, że pracownik, ktory jest dyskryminowany z powody narodowości lub też obawia się zwrocić na to uwagę swojemu pracodawcy, ponieważ może stracić pracę a przez to możliwość legalnego pobytu w Wielkiej Brytanii. Szkolenie polegało na połączeniu prezentacji na temat polityki rządu dotyczącej tego tematu oraz wyjaśnieniu kwestii prawnych, wspartych przykładami spraw, po ktorych następowała dyskucja. Uczestnicy kursy, mieli możliwość zapozania się nie tylko z czystą teorią, ale także mogli wymieniać między sobą doświadczenia wynikające z kontaktu z osobami przyjeżdżającymi do pracy w Wielkiej Brytanii.

Isang "landas" tungo sa hinaharap?
Mahalaga ang kontribusyon ng mga migranteng manggagawa sa pagbibigay ng serbisyong pampubliko sa UK. Subalit madalas na hindi binibigyan ng halaga at pinagsasamantalahan ang mga migrante. Ang mga unyon ay may mahalagang papel para matiyak na ang mga migrante ay tinatrato ng may dignidad at respeto, at may pantay na kalagayan sa paggawa.

Migranteng Manggagawa at ang Kanilang Karapatan
Nuong ika-18 ng Nobyembre, ilang opisyales ng UNISON ang dumalo sa isang araw na pag-aaral tungkol sa "Migranteng Manggagawa at ang Kanilang Karapatan" na ginawa sa London at inorganisa ng Migrants Workers' Unit at Joint Council for the Welfare of Immigrants (JCWI). Binigyan ng pinaka-bagong inpormasyon ang mga dumalo tungkol sa Batas sa Imigrasyon, laung-lalo na ang tungkol sa bagong Points Based System (na ipapatupad mula Nobyembre 2008 at tuloy-tuloy sa 2008 at 2009) at ilang batas sa paggawa na nakakaapekto sa mga migranteng manggagawa. Ang dalawang barrister na nagmula sa JCWI ay may espesiyalidad sa dalawang seksiyon ng batas na ito, na kadalasan ay may koneksiyon sa kalakhan ng mga kaso sa usapin ng karapatan ng mga migrante. Halimbawa, may mga migranteng manggagawa ang dumaranas ng diskriminasyon dahil sa kanilang kasarian o lahi, na takot magsampa ng reklamo laban sa kanilang mga amo dahil baka sila patalsikin sa trabaho at dahil dito ay mawalan din ng karapatang manatili sa bansa. Hindi lamang natuto ang mga dumalo ng mga teorya, kundi naibahagi rin nila ang kanilang karanasan sa pakikipagtrabaho sa mga miyembro ng UNISON na nagmula sa ibang bansa at nagtatrabaho na rito.
Ito ang unang pag-aaral na inilunsad, at sa tulong ng JCWI, gusto naming maglunsad ulit ng ganitong klaseng kurso sa susunod na taon.
