Guidance on how to do a safe secondment in contracting-out situations

Secondments have been widely used instead of TUPE transfers when services are transferred to the private sector. However, the ‘Celtec’ legal ruling has caused many employers to question the legality of agreeing secondments in place of TUPE transfers. The guidance will assist in conducting ‘safe’ secondment arrangements, which we feel are still viable options but must be done with care. Download the guidance (PDF)

Two Tier Workforce

The two-tier code has been partly withdrawn, but still applies in Scotland and Wales, and can still be applied by local discretion in England.
